Macaré, Architect, ("Architect") (individually a “Party” and collectively the “Parties”). WHEREAS, the District is authorized by Section 4529.12 of the California Government Code to contract with and employ any persons for the furnishing of architecture, landscape architecture, engineering, environmental services, land surveying, and construction management through a fair, competitive selection process (e.g., by using a request for proposal or request for qualification process); and WHEREAS, the District is in need of such services and advice and the Architect warrants that it is specially trained, licensed and experienced and competent to perform the services required by the District; and WHEREAS, the Architect agrees to perform the Services described in this Agreement in...
